Acceptance of Terms

By accessing our website or requesting our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our website or engage our services.

Services

UPG Landscaping provides landscaping, excavation, hardscaping, retaining walls, site preparation, skidsteer service, material delivery, and related services across Prince Edward Island.

All services are subject to availability, weather conditions, and site accessibility. We reserve the right to decline or modify a project based on our assessment of the site and scope of work.

Estimates and Pricing

We provide free, no-obligation estimates based on the information available at the time of assessment. Final pricing may vary if site conditions, project scope, or materials change after the estimate is provided.

Any estimate or quote is valid for 30 days from the date issued unless otherwise stated in writing.

Scheduling and Cancellations

Project schedules are subject to weather and equipment availability. We will make reasonable efforts to complete work within estimated timeframes but do not guarantee specific completion dates.

If you need to cancel or reschedule a confirmed project, please notify us as early as possible. Cancellations made with less than 24 hours' notice may be subject to a fee to cover mobilization or material costs already incurred.

Payment Terms

Payment terms for each project will be outlined in your estimate or agreement. Unless otherwise agreed, payment is due upon completion of the work.

For larger projects, we may require a deposit or progress payments. Late payments may be subject to additional fees or interest as permitted by applicable law.

Site Conditions and Access

You are responsible for providing safe and reasonable access to the work site, including marking or disclosing the location of underground utilities, septic systems, or other hazards. UPG Landscaping is not liable for damage to unmarked utilities or hidden site conditions.

If unforeseen site conditions are discovered during the project that affect the scope or cost of work, we will notify you and adjust the estimate accordingly before proceeding.

Permits and Approvals

Unless otherwise agreed in writing, the property owner is responsible for obtaining any required permits, zoning approvals, or approvals from homeowners' associations or municipalities. We can assist with information where possible, but responsibility for compliance rests with the owner.

Warranties and Workmanship

We stand behind our workmanship and will return to correct issues directly related to our installation or work within a reasonable period after project completion. This warranty does not cover damage caused by natural settling, weather, ground movement, improper maintenance, third-party modifications, or normal wear and tear.

Limitation of Liability

To the fullest extent permitted by law, UPG Landscaping shall not be liable for any indirect, incidental, or consequential damages arising from our services. Our total liability for any claim is limited to the amount paid for the specific services giving rise to the claim.

Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You may not attempt to gain unauthorized access to the site, disrupt its operation, or use it to transmit harmful content.

All content on this website — including text, images, logos, and design — is the property of UPG Landscaping and may not be reproduced without our written permission.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
